These Terms of Service ("Terms") govern your access to and use of the Custom Heroes website and services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website and services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Service Description

Custom Heroes provides an AI-powered service for creating personalized children's books. Every book package includes:

• AI-generated story text based on your inputs
• AI transformation of uploaded photos into storybook characters
• AI-generated illustrations for each page
• Professionally printed book (softcover or hardcover) shipped to your address
• Digital PDF download available immediately after creation
• Character Library for saving and reusing characters
• 5 revisions to perfect your book
• FREE activity sheets with every book

Books are available in 12, 16, or 20 page lengths with softcover or hardcover binding options.

3. Account Registration

To use our services, you must create an account. You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

4. Payment and Pricing

All book packages include a professionally printed book plus digital PDF download. Pricing is based on page count and binding type:

Softcover Books:

• 12-page book: $34
• 16-page book: $39
• 20-page book: $44

Hardcover Books:

• 12-page book: $49
• 16-page book: $54
• 20-page book: $59

All packages include:

• Professionally printed book shipped to your address
• Digital PDF download available immediately after creation
• 5 revisions to use across character styling or illustrations
• FREE activity sheets with every book

All payments are processed securely through Stripe. Books are custom-printed on demand and are non-refundable once production begins, except as outlined in our Refund Policy. Prices are subject to change with notice.

5. User Content and License

When you upload photos or provide information for your book:

• You retain ownership of your original content
• You grant us a license to use, process, and modify your content solely for providing our services
• You represent that you have all necessary rights to the content
• You confirm that content doesn't infringe on third-party rights
• You have permission from individuals appearing in photos

We reserve the right to refuse or remove content that violates these Terms, is inappropriate, or that we find objectionable.

6. AI-Generated Content

Our service uses AI to generate content. Please understand that:

• AI-generated content may contain errors or unexpected results
• You have the ability to edit and review content before finalizing
• We don't guarantee specific outcomes from AI generation
• Generated content is for personal use unless otherwise agreed
• You are responsible for reviewing content for appropriateness

7. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of Custom Heroes or our licensors and is protected by intellectual property laws.

The personalized books you create are for personal, non-commercial use. You may not reproduce, distribute, or sell the books without our written permission, except for personal gifts or family use.

8. Acceptable Use

You agree not to:

• Use our service for any illegal or unauthorized purpose
• Upload content that is offensive, harmful, or inappropriate for children
• Attempt to bypass any security measures
• Interfere with or disrupt our services
• Use automated systems to access our service without permission
• Resell or commercially exploit our service without authorization

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the specific service
• We are not responsible for third-party services or content

10. Indemnification

You agree to indemnify and hold Custom Heroes, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our services will immediately cease. You may also terminate your account at any time by contacting us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.

13. Printed Books and Shipping

Every book package includes a professionally printed copy shipped to your address:

• Production: Books are custom-printed after you complete and approve your book
• Timeline: Production takes 1-2 business days, shipping 5-7 business days
• Quality: We use professional printing with 80lb glossy paper and library-grade binding for hardcovers
• Shipping: We are responsible for safe delivery to the provided address
• Damage: We replace damaged or misprinted books free of charge
• Lost Packages: We will reship lost packages at no additional cost
• International: Currently limited to US addresses only

Important: Books are custom-made products and cannot be returned for refund once production begins. Please review your book carefully during the creation process before finalizing.

You are responsible for providing accurate shipping information. We are not liable for delays or non-delivery due to incorrect addresses or force majeure events.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by email or through our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
